show moreOn April 21, 2024 around 3:29 AM, Officer John Simonetti with the Mount Olive Police Department responded to a report of a motor vehicle collision on Center Street. As he arrived on scene, he observed that a 2018 Nissan Sentra had struck a parked 2009 Honda Civic. He asked others at the scene who was driving and made contact with the 21-year-old driver of the Nissan Sentra, who was identified as Kelsey. As he was speaking with Kelsey, he detected the odor of alcohol and observed other indicators of impairment. He asked Kelsey where she was coming from, and she told him that she had gone to a restaurant in Jersey City and then went to Hoboken before her friend drove them back about 45 miles to Mount Olive. While she did not drive, she had forgotten her ID at her friend’s house, so she had driven a short distance to retrieve it. As she was headed home, she struck a parked vehicle resulting in severe damages. Based on the motor vehicle accident and his suspicion of impairment, Officer Simonetti asked Kelsey perform field sobriety exercises. Sergeant Tyler Mullooly started with the Horizontal Gaze Nystagmus (HGN) test. During the HGN test, he observed 4/6 indicators of impairment. The second exercise was the Walk and Turn test. During the Walk and Turn test, Kelsey failed to touch heel-to-toe on each step, turned improperly, and took an incorrect number of steps. The final exercise was the One Leg Stand test, and Kelsey failed to raise her foot in the proper fashion while using her arms for balance.Based on the motor vehicle accident, her indicators of impairment, and her inability to adequately perform the field sobriety exercises, Kelsey was placed under arrest for driving under the influence. After she was placed under arrest, Kelsey was transported to the Chester Police Department because the Mount Olive Police Department did not have an operable breathalyzer machine. Officer Simonetti read her the Standard Statement for Motor Vehicle Operators, and she agreed to submit breath samples for testing. Her Alcotest results indicated a BAC of 0.13%, which was over the legal limit of 0.08%.
