show moreAround 12:25 PM on March 17, 2024, Officer Summerville with the Lakewood Police Department responded to a report of an intoxicated driver with a flat tire on Larchmont Avenue. As Officer Summerville returned to his patrol car, Officers Costanzo and Wallace arrived on scene to assist. As Officer Wallace was speaking with her, she detected the odor of alcohol and noticed that her eyes were bloodshot and glossy. Based on their suspicion of impairment, Allyson was asked to perform field sobriety exercises.
The first field sobriety exercise was the Horizontal Gaze Nystagmus (HGN) test, and Officer Wallace observed a lack of smooth pursuit, distinct and sustained nystagmus at maximum deviation, and the onset of nystagmus prior to 45 degrees. Vertical gaze nystagmus was not present in either eye. The second exercise was the Walk and Turn test, and Allyson did not touch heel-to-toe on each step and stepped off the line while walking. The final exercise was the One Leg Stand test, and Allyson failed to raise her foot in the proper fashion and swayed while balancing.
Based on the damage to her vehicle, the odor of alcohol, the open container, and her inability to adequately perform the field sobriety exercises, Allyson was placed under arrest for OVI. Officers Costanzo and Wallace transported to the Lakewood Jail, where she was booked for OVI. At the LPD jail, Allyson refused to submit breath samples. Since this was her second OVI offense, so she was advised that her license was suspended for two years. Allyson was subsequently released to her sister and charged with the following offenses: OVI (4511.19), OVI refusal (4511.19A2), and open container (529.07).
