show moreOn June 26, 2024 around 1:55 PM, Patrolwoman Kristin Altimari with the Red Bank Police Department observed a driver of a 2012 Toyota Corolla using his phone while driving on W Front Street in the vicinity of Club Court. She initiated a traffic stop and made contact with the driver, who was later identified as 26-year-old Brian Lee. She asked for his driver’s license, but he initially provided her with a credit card instead. She told him that he was using a wireless device, driving without his seat belt, and he had a tail light that was not working.
As she was speaking with Brian, she detected the odor of alcohol. Based on her suspicion of impairment, Brian was asked to exit the vehicle and perform field sobriety exercises. The field sobriety exercises included the Horizontal Gaze Nystagmus (HGN) test, Walk and Turn test, and One Leg Stand test. He was unable to perform these tests in a satisfactory manner.
